Phase 3 of CBP’s CAPE System Due to Launch on October 6, 2026

Brandon Lord, Executive Director of Trade Programs with CBP provided a CAPE update on September 15, 2026. The declaration confirmed that the third phase of the CAPE system will go live on October 6, 2026.

 

Beginning October 6, 2026, plaintiffs who submitted a valid importer of record number to CBP by July 30, 2026, will be eligible to file CAPE declarations for Phase 3. This phase will address finally liquidated entries subject to IEEPA duties for importers who filed suit with the Court of International Trade (CIT) and obtained an order for reliquidation.  

 

According to the latest update, CAPE declarations that passed file validations now cover 27.2 million entries, with 19.94 million of those entries having been liquidated or reliquidated without the application of IEEPA duties.

 

However, CBP noted that 6.1 million entries included in CAPE declarations failed entry-level validations. The primary reasons for these failures include entries submitted past the 90-day reliquidation window, absence of a Chapter 99 Harmonized Tariff Schedule number for IEEPA duties, or the entry having already been submitted in a prior CAPE declaration.

 

In terms of financial impact, approximately $134.7 billion in potential and certified refunds have been accepted for processing in CAPE. Of this amount, around $122 billion in refunds—including both duties and interest—have been completed, certified by CBP, and sent to the U.S. Department of Treasury for disbursement. CBP’s financial system receives regular updates from Treasury, confirming ongoing refund distributions.

 

CBP continues to review and finalize outstanding potential refunds through CAPE’s Review and Liquidation/Reliquidation component. As of the latest reporting, 20,184 refunds totaling about $1.3 billion have not yet been transmitted to Treasury because the required Automated Clearing House (ACH) account information has not been provided by the importer of record or their authorized CBP Form 4811 designee.  

 

According to a September 17 order from Court of International Trade Judge Richard Eaton, the government is required to submit an additional progress report on the CAPE system by October 6 at 5 p.m. EST.

House Approves New Tariff Powers Targeting Russia’s Trade Partners 

After a 262-159 vote in the House of Representatives, the president will gain enhanced authority to levy up to 100% tariffs on products from as many as 15 countries that are either top buyers of Russian oil or gas, or significant supporters in Russia’s efforts to evade sanctions, under the Lindsey O. Graham Sanctioning Russia and Iran Act. The act also requires tariffs of up to 500% on most Russian goods, which will be layered on top of current Section 301 and Section 232 tariffs and other trade measures. Targeted countries include China, India, Turkey, Azerbaijan, Hungary, Slovakia, United Arab Emirates, Singapore, Kazakhstan, and Kyrgyzstan, but only those that have increased Russian fossil fuel imports after the bill’s enactment will qualify for sanctions. The president must impose these tariffs within 30 days of the law taking effect.
